POINTS TO MAKE

2. Annex attempts to achieve our objectives, both internally and in
terms of maintaining confidence. in Hong Kong while taking account of
Chinese sensitivities. Important to make it clear that those who
retain British nationality after 1997 will have right of abode in
Hong Kong, not UK.

Paragraph 1. This makes it clear that ethnic Chinese in Hong Kong are considered to be Chinese nationals. Will help us if any
who are British nationals after 1997 claim right of abode in UK on
grounds of not having any other nationality.

Paragraph 2(a). This covers retention of British nationality.
No need to tell Chinese now what form would be appropriate, but
think it will be necessary to create new form.

5. Paragraph 2(b). 5 alternative formulations on transmissibility.
Goes from first alternative ie retention of present position.
Unlikely Chinese will accept transmissibility at all, and certainly
not in this form. But for sake of relations with EXCO, must be seen
to try to obtain agreement. Therefore propose second alternative
transmissibility for one generation with third as fall-back
position.

Paragraph 3. Provides for right of abode in Hong Kong. Term
"Hong Kong belonger" covers all BDTC (Hong Kong)s. No person with
right of abode now would lose it under those proposals.
