contained in the 1894 Act remain sound and that there is

no need for fundamental changes, for instance as regards

the basic qualifications for ownership, the information required to be kept on the register, the facilities for

recording title and mortgage, etc. However it was generally

recognised that the system is out of date and cumbersome

to operate and that a number of anomalies have developed

over the 90 years since these provisions were enacted, which

need to be rectified. With regard to centralisation of the

registry functions some fishing interests expressed reserva-

tions in that in certain areas the present system provides

them with a personal service which they value. These points

and the views put forward by the Dependent Territories have

been taken into account in preparing the proposals set out

below.

ELIGIBILITY FOR REGISTRATION BASIC PRINCIPLES

Territorial scope

15.

The new Act will apply to the United Kingdom. It

will be extended to the overseas Dependent Territories

(Anguilla, Bermuda, British Virgin Islands, Cayman Islands,

Falkland Islands, Gibraltar, Hong Kong, Montserrat, St. Helena,

Turks and Caicos Islands) and to the Channel Islands and Isle

of Man by Order in Council in consultation with the Governments

concerned. The British Register will consist of the UK

Register and any registers maintained in the dependencies.
