HONG KONG AGREEMENT: REGISTRATION AT THE UN
PROBLEM
1.
How to proceed with the registration of the Hong Kong agreement at the United Nations.
RECOMMENDATION
2. I recommend that at his informal meeting with the
Chinese Foreign Minister in Peking the Secretary of State should explore the possibility of joint registration by the British and Chinese Governments. NTD and Legal Advisers
agree.
BACKGROUND AND ARGUMENT
3. Our normal practice with bilateral agreements is to register them unilaterally with the United Nations, which we consider we are obliged to do under Article 102 of the UN
Charter. The Chinese do not as a matter of practice register their international agreements with the UN, though they appear not to have objected to other parties to such
agreements doing so.
