(e) elected and appointed members who vacate
their seats on dissolution of the
Legislative Council, or in the case of appointed members, upon expiry of the period specified in the Instruments of their appointment, to be eligible for re-election or re-appointment as the case may be;
(f) the seat of an elected or appointed member who absents himself from attendance at
the Legislative Council for more than three months without leave from the Governor to be declared vacant and for such member there- upon to cease to be a member of the Council;
(g) any question of the right of an elected
member, or of an appointed member, to take and retain his seat in the Legislative Council to be determined by the High Court of Hong Kong;
(h) a session of the Legislative Council to be
held once in every calendar year, commencing and ending on such dates as the Governor may appoint, provided that the period between sessions shall be limited to not more than three months;
(i) an election for elected members to be held
within three months of the dissolution of the Legislative Council subject to the proviso that, where the seat of an elected member is declared vacant within three months of the scheduled date of such dissolution, no by-election shall be held and the seat shall be permitted to remain vacant until filled at the succeeding
(general) election;
(j) the consideration of any bill or other matter
before the Legislative Council not to be affected by a dissolution of the Council, and for such consideration to be continued at the next session as if the dissolution had not taken place.
You will note that we have provided for the incorporation of the provisions of an electoral ordinance by reference. It will be necessary for the Governor to obtain specific instructions on this ordinance before assent. We have done this because
/ (a)
