after 1997 any powers and
privileges derived from the
Common Law would cease to have
effect in Hong Kong, and if they
be retained must
therefore be the subject of
legislation at some stage;

to smooth the transition it
might be desirable to make the
necessary changes to codify
these points earlier rather than
later;
(c)
the
powers
and privileges
derived from case law have never
been brought out in any ruling
in Hong Kong, and it is
desirable
in itself that there
