An Ordinance to amend the law relating to elections and appointments to District Boards and elections to the Urban Council and for matters connected therewith.

Enacted by the Governor of Hong Kong, with the advice and consent of the Legislative Council thereof.
PART I
PRELIMINARY
1. (1) This Ordinance may be cited as the District Boards and Urban Council Elections (Miscellaneous Amendments) Ordinance 1984.
(2) Sections 2, 4, 5(a), 7, 8, 9, 10 and 12 shall come into operation on 1 April 1985.
(3) Section 15 shall come into operation on a day to be appointed by the Governor by notice in the Gazette.
PART II
AMENDMENTS TO THE DISTRICT BOARDS ORDINANCE
(b) by being renumbered as subsection (1);
(c) by inserting after subsection (1) the following—-
"(2) Where the Governor makes an order amending or revoking an order made under subsection (1) such first mentioned order may make such transitional provisions relating to such amendment or revocation as may be necessary or expedient.".

Section 9 of the first principal Ordinance is amended by deleting sub- Amendment of section (4)(ƒ)(iii).

7. The first principal Ordinance is amended by adding after section 9 the Addition of new following-
"Disqualification
of Chairman of Rural Committee.

Section 2 of the District Boards Ordinance ("the first principal Ordinance") is amended in the definition of "appointed member" by deleting “(a) or”.
3. Section 3 of the first principal Ordinance is amended by inserting after subsection (4) the following--
"(5) Where the Governor in Council makes an order amending or revoking an order made under subsection (1) such first mentioned order may make such transitional provisions relating to such amendment or revocation as may be necessary or expedient.".
Amendment of section 6.

Section 6 of the first principal Ordinance is amended-
(a) in subsection (1)—

9A. The holder of the office for the time being of Chairman of a Rural Committee referred to in section 6(1)(b) who—
(a) has in Hong Kong or any other territory or country been sentenced to imprisonment, whether suspended or not, for a term exceeding 3 months without option of fine;
(b) has been convicted of treason;
(c) is a member of any parliament, assembly or council, whether central or local, of a foreign country or a salaried functionary of a foreign government;
(d) is an undischarged bankrupt or, within the previous 5 years, has either obtained his discharge in bankruptcy or has en- tered into a composition with his creditors, in either case without paying his creditors in full;
(e) has been convicted-
(i) of a corrupt practice or illegal practice within the meaning of the Corrupt and Illegal Practices Ordinance, other than the illegal practice consisting of a contravention of any of the provisions of section 19(2) of that Ordinance, or of a corrupt or illegal practice within the meaning of any other enactment for the time being in force providing for the punishment of corrupt or illegal practices;
(ii) of any offence under the Prevention of Bribery Ordinance;
(f) fails throughout a period of 6 consecutive months to attend any meeting of the Board unless such failure was due to some reason approved by that Board,
shall not be entitled to attend, take part in or vote at any meeting of a Board.".

(i) by deleting paragraph (a);
(ii) in paragraph (b) by inserting after "Board" the following—
subject to section 9A";
(b) in subsection (2) by deleting ", other than a person appointed under
subsection (1)(a),”.
8.
Section 14 of the first principal Ordinance is amended—

(a) in paragraph (a)(ii) by deleting "Supreme" and substituting the following
"High";
(b) in paragraph (c) by deleting "who is appointed under section 6(1)(a) or”;
