THE RULES ABOUT RETURNING REFUGEES WHENCE THEY CAME

The 1951 Convention provides that a refugee shall not be

returned to a country where his life or freedom would be

endangered on account of race, religion or political opinion.

1951 CONVENTION ON STATUS OF REFUGEES:

DEFINITION OF REFUGEE

In the 1951 Convention a refugee is generally defined as

a person outside his home country who is unwilling to seek the

protection of that country owing to well-founded fear of

persecution for reasons such as race, religion or political

opinion.

PROCEDURES FOR DETERMINATION OF REFUGEE STATUS

The 1951 Convention, whilst it defines who is a refugee,

does not provide a procedure for determining refugee status

in particular cases. This is a matter for each Contracting

State to establish according to its own constitutional or

administrative procedures. The procedures for determining

refugee status in this country are the responsibility of my

right honourable Friend, the Home Secretary.
