Entitlement of Expatriate Children to LEA Grants

There has for some years been confusion over entitlement of

children of British citizens working in Hong Kong to higher

education subsidies in the UK. House of Lords ruling of 15 December

1982 on ordinary residence' enabled those children resident 'for

the purposes of education' in the UK for 3 years or more, to claim

that they were 'home students' for purposes of university fees and

LEA awards. However, following Sir Keith Joseph's statement in

Parliament on 30 March 1983, HMG took administrative and legal action to restore the previous situation. Claimants will now, as before have to argue their entitlement individually with the LEA and

university concerned.

5. This means in practice

it difficult to claim 'home'

Department of Education and Science have still to issue guidance to local

authorities on this. We are strongly recommending to them that children of UK expatriates in Hong Kong, particularly those who are

members of Hong Kong civil service, should have benefits of home

student status.
