they did not qualify to become British citizens under a) or b) of Section 11(2) of the British Nationality Act 1981 or did not retain their right of abode under Section 39(2b) of the same Act.

Mr Hill, Legal Adviser to Nationality and Treaty Department, and I are agreed that the existence of these people means that it would be embarrassing for Lord Skelmersdale to give such a firm statement as that contained in the last sentence of paragraph 2 of the Background Note and after consultations with Mr Howell and Mr Campbell of NTD, we are of the view that this last sentence is best omitted. This is all the more so, given that Lord Avebury's question is directed to immigration matters as they relate to the dependent territories and it is not directed at immigration as it relates to the United Kingdom.
