EXTRADITION OF FUGITIVES FROM HONG KONG TO MACAU

1. Mr J Powell, Vice-Consul Lisbon, telephoned this morning for advice on carrying out the requests in paragraph 3 of Hong Kong telegram number 1509.-wp.

After consulting Mr J O Hill I telephoned back to say that Mr Powell should ask the fugitives' defence lawyer (or preferably request the Embassy's Legal Adviser to ask him) the following questions:-

whether the lawyer had been informed of the appeal to the Supreme Court

when he was informed of the appeal

whether he informed his client

whether he contested the appeal

whether he appeared in court

In each case if the reply is no the lawyer should be asked why not.

If the reply is yes he should be asked for details, dates

etc.

Mr Powell said that it would not be practicable to ask the Embassy's Legal Adviser to put these questions. since Portuguese lawyers would not be involved in questions of each others conduct.

4. I further advised Mr Powell that he should refer the answers to the above questions to the Embassy's honorary Legal Adviser and ask him to advise (consulting the Portuguese equivalent of the Bar Council).

whether he had acted contrary to any procedures laid down for conduct of lawyers.
