REVISED EXTRADITION TREATY WITH DENMARK

1.

Extradition between the United Kingdom and Denmark is at present governed by the 1873 Treaty for the Mutual Surrender of Fugitive Criminals, as amended by the Supplementary Convention of 15 October 1935 and the Exchange of Notes of 24 August 1979 (Treaty Series C. 779, Cmd. 5172 and Cmnd. 7753 respectively). By Article XIII of the Treaty of 1873, its provisions apply to the Colonies and foreign possessions of the High Contracting Parties.

At the request of the Danish Government following the enactment of new extradition legislation by Denmark in 1967 negotiations were undertaken to revise the 1873 Treaty.

The

text of a draft revised Treaty has now been agreed between the two Governments and is due to be signed shortly. A copy is

enclosed.

The termination of the existing Treaty (as amended) under Article 21.3 of the new Treaty will also be effective as regards the dependent territories to which the existing Treaty applies. Article 2.1.b) provides for the application of the new Treaty to be extended to territories for the international relations of which the United Kingdom is responsible, and the purpose of this despatch is to propose that the new Treaty should be extended to the territories under the administration of the addressees of this despatch. You may wish to bring the Treaty to the notice of those concerned in your territory and consult any local interest that may be affected. I should be grateful to learn by 30 July whether you see any objection to the new Treaty being applied. Application
