Suggested amendments to draft UK brief
Paragraph_9
For last two sentences substitute:
'It was the practice, as noted by Professor Shearer, to designate all Commonwealth countries as and when they became independent. More recently we have examined the basis for surrender from a country to be designated, and have been prepared to delay designation until the country has implemented the Scheme'.
This amendment takes account of the fact that we have deferred designating Vanuatu pending the enactment of adequate legislation providing for surrender. Similarly we may not designate Brunei when it assumes full responsibility for its external affairs in 1984 unless the necessary legislation has been enacted.
Paragraph 11: Line two: for 'and' substitute 'or'.
Paragraph 12:
First sentence: before 'designated' insert 'generally'. After reciprocity' begin new sentence:
'As a matter of practice we have wished to satisfy ourselves...'.
Page 6: Insert after paragraph 19 new paragraph:
'19A. The Cayman Islands are apparently opposed to any revenue offences becoming extraditable. Their position would need to be safeguarded in any extension of extradition to 'broad' fiscal offences (viz. those commonly recognised as criminal) where national revenue was the victim'.
Paragraph 21: Amend heading to read: ''No List' Method' and substitute for 'adopting the list method': 'adopting the 'no list' method'.
Paragraph 22: Third line: delete 'that'.
Paragraph 26: At the end of paragraph insert:
'[Hong Kong strongly support Professor Shearer's suggestion (paragraph 24 above)]'.
