operating under the 1881 Act. For example the request to New Zealand for

Daily in 1979 failed when the Supreme Court discharged him on the basis that the 1881 Act could no longer apply to New Zealand: New Zealand has since

re-applied the Act by appropriate legislation and presumably intends to

implement the Scheme in due course. Similar views have been expressed by the

Deon authorities in Jamaica and Trinidad although no application has refused for

this reason. The application to Barbados for Biggs failed because of a

technical failure to designate the UK.

LINE TO TAKE

The Act is applied by designation to Commonwealth countries and we have

designated all such countries at, or soon after, they have achieved

independence without secking assurance as to reciprocity, although as a matter

of practice we have satisfied ourselves as to the legal basis of extradition

from that country. We believe that all Commonwealth countries who have

implemented the Scheme / designated the UK or taken whatever action has been

necessary. We would hope that there was no need for any administrative

review as proposed by Professor Shearer.
