(A) General Information

The Prisoner was the fifth child of the family. Born in China, he was given secondary education. However, due to the Cultural Revolution then taken place in China when academic pursuit was given the least emphasis, his academic attainment was described to be poor. After completion of school he was arranged to work in a rural farm. However he had only worked there for one day and had successfully sneaked into Hong Kong through illegal means together with his elder brother SIU Yik-lai in November 1973.

Upon arrival, the two of them took shelter at their aunt Madam TAI Choi-chun's place at No. 90 Fuk wah Street, 5/F., Kowloon and had helped with the aunt's domestic knitwear business. Two months later the brother left the aunt's place to seek open employment. The Prisoner had stayed with Madam TAI for about another six months and he left as well. He reported to have worked as a cashier in a restaurant, namely Tung Ting Chuen at Argyle Street, Kowloon for about half a year with lodging provided. Thereafter, he worked as a hawker, selling handbags at the hawker permitted area at Tung Choi Street, Kowloon. Since then, his contacts with the aunt and brother

had been greatly reduced to the extent that they had not seen the Prisoner for over about one year at the time of the present offence.

Through business contacts in hawking, the Prisoner came to know Mr. WONG Ping, WONG Chung-chun, who was a handbag whole-saler as well as a proprietor of The Man Tat electrical appliances company. The Prisoner claimed that he had since 1974 been working for Mr. WONG in selling handbag at Tung Choi Street or as a sales- representative selling TV sets on alternative basis. In 1978, the Prisoner came to know a Chinese girl, named Ping Ping, who was also a sales representative working for Mr. WONG. He began to cohabit with Ping Ping six months later. The Prisoner alleged to have little knowledge about the girl's background.
