by the petitioner to another drug trafficker. The petitioner

told CHIANG to wait for them in the car as the contact might

not wish another stranger to be present during discussions about the purchase of heroin. The events that took place thereafter

are described in the cautioned statement of the second accused;

this statement differs substantially from the evidence given in court by the second accused.

According to that statement he and the petitioner lured the deceased into the flat in Yuen Long where the petitioner struck the deceased over the head with a wooden pole. Thinking

the deceased was already dead, they proceeded to chop up the body, put the flesh through a mincing machine and dispose of the skull and skeletal remains in two green canvas bags in

the sea off Castle Peak.

8. In his own cautioned statement the petitioner claims that

he had seen the deceased attacked by a number of men in Yuen

Long and had not seen him again thereafter. On 1st September 1980 the two green canvas bags containing human remains, including a head, were washed up on the beach near Castle Peak.

The wife of the deceased had reported him missing when he did not return home from his appointment with the petitioner

on the 7th August 1979. On 29th September 1979 both the petitioner and the second accused were arrested.
