CHARGE AND CONVICTION

The petitioner, Chinese male accomplice
were charged with the murder of WONG Chun-leung deceased. There was an appeal against the first jury decision because of a technical fault in the first judge's summing-up. A retrial was heard before Mr. Commissioner Hooper. The jury found both defendants guilty as charged on 24th April 1981.

They were both sentenced to death. Their
FACTS
2. The body of the deceased, WONG Chun-leung, was found in a drive-way in Cheung Hang Village. The body, which was in a semi-decomposed state, exhibited a number of stab wounds and a
wound from a chopper which had almost severed the neck.
3. Police investigations revealed that the deceased had been involved in drug trafficking. On 15th October 1979 the deceased
accepted $18,000 from one
as advance payment for a
quartity of drugs which the deceased was to deliver at the
Washington Guest House the following day. purchaser lived at the guest-house which he ran in partnership with the petitioner's co-convicted,

to avoid having to deliver the drugs, and to extract more money from
the deceased arranged to have himself
"arrested" at the guest house. After the bogus arrest the deceased telephoned to
to ask for ransom money to secure
the deceased's release from the police.
