deceased on the 15th October, before he had actually received

the drugs. The deceased was supposed to supply the drugs that day

but he prevaricated and did not hand over the drugs.

Eventually still waiting for the drugs on the 16th

met the deceased, who told

October after 4.00 p.m.

that he had the drugs on him, but the drugs. The deceased and

then went to an address

called the Washington Guest House, an establishment owned by

where the deceased was supposed to deliver the drugs to

urchaser.

Waiting at the Washington Guest House were two men who claimed to be CID officers of the Royal Hong Kong Police Force and

who on the deceased's arrival there searched the deceased in a

separate room, and who claimed to have found dangerous drugs on

him. The deceased was thus taken away without handing over or

delivering the drugs to

that evening failed to

establish the whereabouts of the deceased at any police station.

It was common ground that

came to believe that he

had been the victim of a swindle by the deceased.

That evening (namely the 16th October 1979)

telephoned the first defendant and later on that same evening he went

to see the 1st defendant in the company of time on the 1st defendant was very much involved in the subsequent

events assisting

in connection with this matter right up until shortly before 8 o'clock on the 19th October 1979. Evidence

19th October 1979 the deceased was taken from

Kok flat to a hill-side and murdered because of his part in the

swindle.

There could be no doubt that the deceased did meet his

death sometime after 8 o'clock on the evening of the 19th October 1979.
