CHARGE AND CONVICTION

27 years old) was charged with the murder of YEUNG Pui-chung on 26th January, 1980. On 16. 12. 80. he was found guilty of murder by a jury and sentenced to death. His appeal against conviction for murder was dismissed by the Court of Appeal on the 29th June, 1981 and the Director ofμ Legal Aid on the 30th September, 1981, after receiving Counsel's advice, refused further assistance to MA who wished to appeal

to the Privy Council.

In November 1981 the Commissioner of Prisons

requested the Director of Legal Aid to assist in the preparation of a petition, which was received in early February 1982.

FACTS

The deceased YEUNG Pui-chung lived in the rear portion of wooden hut number 265 Yuen Dao Ngam Village, Chaiwan. On the evening of 25. 1. 80. he had a meal with

and her family at her house. They arranged to meet for tea next morning. When YEUNG failed to show up for that appointment she went to his hut, but could not gain entry.

Later she met 2 colleagues of the deceased who were concerned

that he had not arrived at work. Together they went to the hut

and this time were able to enter it.
