He related the present offence was committed out of monetary gain as he was quite poor at that time. He claimed he was not under the control or direction of any one though the prisoner was the one who initiated the idea of stealing from the deceased and provided necessary information on his whereabouts. Before the robbery, they three already had discussions on the parti culars of this plot and agreed to share the stolen properties evenly. CHEUNG claimed that he only brought along the knives for use in case of need when he and LY Minh went up to the deceased's premises, and allegedly he had never thought that it would have ended up in the death of the deceased.

Similar to the other accomplice, LY claimed he only knew the prisoner superficially when he joined him and some others to tea sometimes. He claimed the prisoner was generally relating smoothly with others and had a pleasant character. LY claimed the present offence was only committed from an idea which came up in a casual occasion when they three were all short of money at that time.

F. INTERVIEW WITH THE PRISONER

The prisoner was interviewed at Stanley Prison on 9.9.80. He appeared to be verbal but so defensive that he could hardly commit himself in any point of view. Yet he seemed to be fully aware of what he was doing and how he had come to get involved in the present offence but he denied to have any action or pre-meditated intention of killing the victim. He claimed he only aimed, at some monetary gain to solve his financial problem for migration to Taiwan. The prisoner was sorry for his keeping on thinking of his "yesterday's glories" which made him fail to settle down realistically in any new employment after leaving the insurance. field, and he was thus eager to start anew in a totally different environment, such as Taiwan, where he could overcome his weakness. Towards the present offence, the prisoner claimed he had only committed it from momentary greed and denied having any other similar evil thinking before. The prisoner showed his regret but he did not think it justifiable for him to have such a heavy punishment as he thought he had only committed a conspiracy of robbery, and he was thus preparing for another appeal.

SUMMARY

Though brought up in a single-parent family environment, experiencing relatively inadequate family care and supervision, the prisoner nevertheless enjoyed a normal upbringing with proper provision of schooling opportunity. Starting as a secondary school graduate, the prisoner had worked for a few years in the field of insurance and attained some sense of achievement in it. After he left this field, he could not settle down realistically in other appointments with lower ranks, and thus became out of job very often. This inevitably led to his increasing fondness of gambling, undiscriminative association, and unrealistic budgetting. And finally he resorted to the idea of robbery to solve his financial problem

As a person, which brought to his involvement in the present offence. the prisoner was generally described to be a pleasant and likeable character among his friends, a responsible and affectionate member of the family, get a competent but rather dishonest employee in his job.
