NOTE BY THE ATTORNEY GENERAL
CHARGE AND CONVICTION
:
The Petitioner, CHAN Ting-san (aged 26 at the time of the offence) (the 3rd accused), was indicted together with two others, namely, CHEUNG Wai-bun (aged 19 then), (the 1st accused) and LY Minh (aged 21 then) (the 2nd accused) with the murder of Gahleb Teyfour on 27th June 1979 and with robbing the
deceased on the same day of US$400 and four electronic watches. All the accused were convicted of the offences charged on 19th March 1980 and their appeal against conviction was dismissed
by the Court of Appeal on 15th July 1980.

The 1st and 2nd accused subsequently petitioned for clemency and their death sentences were each commuted to life
imprisonment in September and May of 1981 respectively. .

The Petitioner applied to the Privy Council for special leave to appeal against his conviction but such application was dismissed by the Law Lords on 15th October 1981.
FACTS

The deceased was a 65 year old Syrian who frequently
visited Hong Kong on business trips. His last visit commenced on 17th June 1979. As usual he stayed in the Hong Kong Hotel and on this occasion in Room 1175. It was his habit to receive business contacts in his hotel suite and to pay cash for his
purchases, so he kept quite a large sum of cash in his room.
These facts were known to the Petitioner since he had had
previous business dealings with the deceased.
