of June 1979 at Kowloon in the Colony of Hong Kong they murdered Ghaleb Teyfour. They were additionally charged
with robbery of the said Ghaleb Teyfour which offence is
not the subject matter of this Petition.

THAT the facts as alleged by the
prosecution, which are not now denied by Your Petitioner
in respect of this Petition, were as follows:
(1)
The said Ghaleb Tey four (hereinafter
called "the deceased") paid periodic
visits to Hong Kong and his custom was
to stay at the Hong Kong Hotel.
(ii)
He did much of business from his Hotel
room and therefore there was at any
time likely to be a considerable amount
of cash in his room in order to pay
those people with whom he did business.
(iii) These facts were known to the Appellant
as a representative of a firm in Hong
Kong who did business with the said
deceased.
(iv) The Appellant was able to find out from
the Hong Kong Hotel the room number (1175)
at which the deceased was staying in late
June 1979.
(v)
The Appellant planned to burgle (or rob)
the deceased of some of his cash that
would be in his room.
