The deceased was found to have nine stab wounds on the front of his body, the cause of death being stab wounds to the right lung, liver and heart. The medical witness stated that the bulk of these wounds were caused by the scout knife, although one could have been caused by the kitchen

knife.

The petitioner was medically examined and found to have two small cut wounds to his hands, and numerous abrasions. These were stated to be "relatively trivial".

BACKGROUND

The Crown's case was that the petitioner was a rejected lover who, on realizing that he could not win back the girl he loved, decided that the deceased would not have her either.

After the killing the petitioner was in a very emotional and confused state, and it took some hours to persuade him to leave the roof. where he was threatening suicide.

DEFENCE

The petitioner's defence was provocation, self-defence and emotional outburst. He said he was provoked when he saw the deceased trying to read the suicide letter which, to him,

was an intimate matter between he and Miss WONG. He further

stated that the deceased scorned his powers as a lover, and had provoked him by barricading himself in the bedroom when all he wanted to do was to get him to leave the premises. He stated

that when he broke into the bedroom the defendant attacked him.
