NOTE BY THE ATTORNEY GENERAL

CHARGE AND CONVICTION
The petitioner, Chinese male
(21 years)
was charged that on the 20th day of September, 1980, at Flat D1, Kwan Yick Building, 343 Des Voeux Road West, he murdered
(20 years). On 28th July 1981 he was convicted of murder and sentenced to death. His subsequent appeal was dismissed by the Court of Appeal on the 26th November 1981.

In 1977 the petitioner met a Chinese female Thereafter an intimate relationship developed between the two of them. The petitioner was deeply in love with and in August, 1980, proposed marriage to her. Although
has denied she accepted this proposal, her feelings for the petitioner were obviously deep during much of the relationship.

In April 1980,
began work at the United Overseas Bank, and there met and fell in love with the deceased,

became engaged.
stated in evidence that on several occasions she tried to impress on the petitioner that their relationship was over but without success. A meeting was therefore arranged at a restaurant on the evening of the 19th September to impress this fact on the petitioner. The defendant claimed that this was the first time he became aware of the relationship between the deceased and
and those present described him as being agitated, angry and upset.

After the meeting, the petitioner returned to his home and at 4.51 a.m. on the morning of the 20th September, he
wrote a suicide note to
