An Ordinance to amend the Pensions Ordinance.

Enacted by the Governor of Hong Kong, with the advice and con- sent of the Legislative Council thereof.

1. (1) This Ordinance may be cited as the Pensions (Amendment) Short title and Ordinance 1982.

(2) The amendment to the principal Ordinance made by section 5, and the amendments to the Pensions Regulations made by section 6(f), (Cap. 89. (h)(iii) and (j)(ii) shall be deemed to have effect as from 9 January 1976. sub. leg.)

(3) The amendments to the principal Ordinance made by sections 2(a) and 4(a), and the amendments to the Pensions Regulations made by section 6(c), (d)(i) and (ii), (h)(ii)(A), (i), (j)(iii) and (iv) shall be deemed to have effect as from 30 May 1980.

(4) The amendment to the Pensions Regulations made by section 6(e)(ii) shall be deemed to have effect as from 17 November 1972,

(5) The amendment to the Pensions Regulations made by section 6(g) shall be deemed to have effect as from 9 December 1949.

Section 2(1) of the principal Ordinance is amended by inserting (a) after the definition of "pensionable emoluments" the following

““pensionable emoluments enjoyed" in relation to an officer on leave without salary includes the pensionable emoluments that he would have enjoyed if he had been on duty on full pensionable emoluments;";

(b) after the definition of "Secretary of State" the following-

"pensionable service" means service which may be taken

into account in computing pension;

"qualifying service" means service which may be taken into account in determining whether an officer is eligible by length of service for pension, gratuity or other allow- ance;".

3. Section 5(2) of the principal Ordinance is amended by inserting Amendment of

at the end thereof after "under this Ordinance" the following-

", or, in the case of an officer who has not attained the age of 55 years, he may direct that any pension or other allowance payable under this Ordinance shall not be paid in respect of the period prior to the officer attaining that age; and where such a direction is given and the officer dies before attainment of the age of 55 years, the
