BUT THE CONVENTION WE FOLLOW, IN PRACTICE, IS THAT ALL APPLICATIONS FOR EMPLOYMENT IN THE CIVIL SERVICE ARE, IN FACT, CONSIDERED ON A CASE BY CASE BASIS AND EACH APPLICATION IS CONSIDERED ON ITS OWN MERIT BY HEADS OF DEPARTMENTS OR BY THE APPROPRIATE APPOINTMENT AUTHORITY (E.G. THE SECRETARY FOR THE CIVIL

SERVICE). THE ACTUAL NUMBER OF APPLICANTS WHO ARE KNOWN OR ADMITTED HOMOSEXUALS IS, OF COURSE, VERY SMALL. NEVERTHELESS, HEADS OF DEPARTMENTS ARE WELL AWARE OF THIS CONVENTION. PARAGRAPH 3 OF CIRCULAR 196/82 MERELY LAID DOWN GENERAL GUIDELINES FOR CONSIDERING THE APPOINTMENT OF PERSONS WHO HAVE BEEN CONVICTED OF HOMOSEXUAL OFFENCES OR WHO HAVE ADMITTED TO BEING ACTIVELY ENGAGED IN HOMOSEXUAL PRACTICES. HEADS OF DEPARTMENTS REFER INDIVIDUAL CASES TO THE CIVIL SERVICE BRANCH FOR ADVICE WHEN THERE IS DOUBT ABOUT INDIVIDUAL CASES, AND EACH CASE IS REVIEWED IN THE CONTEXT OF THE NATURE OF WORK TO BE PERFORMED BY THE OFFICER FILLING THE POST, WHETHER AN OFFENCE WAS ACTUALLY COMMITTED AND THE DEGREE OF RISK INVOLVED IN EMPLOYING THE APPLICANT.
