4.15.5 The procedure for the appointment of Judges (other than Chief Justices) is similar to the

above, except that no formal submission is made to The Queen.

4.15.6

Before the name of the officer is submitted for The Queen's approval, or, where this is not required, before The Queen's Instructions for the appointment are sent, or before an acting appointment is approved without the necessity for a Royal instruction, the papers must be referred to the Departmental Legal Adviser. He ensures that the appointment and any instructions issued conform with the constitutional and/or other legislative requirements of the Territory. This applies to all judicial appointments, including appointment to Courts of Appeal, temporary appointments, and, where approval is sought through an FCO Department, acting appointments.

APPOINTMENTS OF PERSONS TO POSTS NOT IN THE PUBLIC SERVICE

The DT geographical Department normally undertakes the appointment of persons for special commissions eg for salary reviews or Commissions of Enquiry, and in other cases where the person appointed will not be filling a vacancy in the public service of the Territory. Such appointments may sometimes be made under Technical Co-operation, in which case there should be early consultation with OMCD (ODM). The DT geographical Department should consult with FCO and ODM Departments as appropriate, in order to draw up lists of candidates.

AIDES-DE-CAMP

Aides-de-Camp are personal employees of OAGs. The OAGs themselves are responsible both for finding them and arranging their conditions of employment. They may, however, ask for the advice and assistance of DT Departments. It is normal for offers of appointment to aides-de-camp to be drafted in the DT geographical Department; but such drafts should always be agreed with the OAG personally.

4.18.1

RECRUITMENT OR RE-EMPLOYMENT OF OFFICERS RETIRED FROM DTS OR FROM THE REGULAR FORCES

The possibility of the engagement for service in DTs, normally on contract, of these officers should be kept in view. When such possibilities arise, the DT Staffing Section is asked to consider them in consultation with the appropriate ODM staffing Department and with the particular agencies mentioned in para 4.18.2. From time to time DT geographical Departments may themselves deal direct with those agencies.
