Explanatory Memorandum

The object of this Bill is to amend the

principal Ordinance to reflect the new citizenship

nomenclature introduced by the British Nationality

Act 1981. This is effected principally by clause 2

of the Bill which amends existing definitions in the

principal Ordinance and inserts new definitions. The

existing reference to "resident United Kingdom belonger"

is superseded by a reference to "resident British

citizen". Clause 2 also provides a new definition of

"Hong Kong belonger" (which expression refers to persons

who have the right to enter and remain in Hong Kong).

Notwithstanding the new definition, all persons who

at present are Hong Kong belongers, will retain that

status.

Clause 3 amends section 8 of the principal

Ordinance (which relates to the right to land and remain

in Hong Kong) by adding a reference to "resident British

citizen"

Clauses 5, 6 and 8 amend sections 19, 20 and 22

of the principal Ordinance (which relate to restrictions

on powers of deportation and removal) by adding references

to "British citizen" and "resident British citizen"

Clause 9 amends section 59 of the principal

Ordinance by adding certain documents to those the

Director of Immigration is already empowered to issue.

to amend the new First Schedule.
