In his minute of 22 October, Mr Burton of Hong Kong and General Department has asked us to reply to Hong Kong's letter of 17 October and, by implication, to their teleletters of 6 September and 18 October.

2. You will remember that in the teleletter of 6 September (folio 20), Hong Kong made some suggested amendments to the H.O. staff Instructions on registration under Section 4(5) of BNA 1981. In their teleletter of 18 October (folio 37) they have suggested amendments to the explanatory guide B for registration under this Section. I have written to Sheila Muir in the Home Office (folio 38) mentioning one of the proposed changes in the first reference and those requested in the second.

One amendment which Hong Kong did suggest to the Staff Instructions I do not feel we can put forward. This is the mention of certain categories of service which may be considered as ''paid or unpaid service as a member of a body established by law' etc. Hong Kong fear that this may be taken to mean that we have already decided that only service in the examples listed will count but by the very use of the terms ''E.G.'' and ''etc'' this is patently not so.
4. Mr Burton's point in paragraph 2 applies not only to Hong Kong but to all our posts. The simple answer is that DSP Vol 43 which contains instructions on handling applications will be issuing shortly and Vol 46 with instructions to Governors will issue before the end of the year in a draft form. This should suffice as applications under the BNA 1981 cannot be accepted, after commencement.
