children born in Hong Kong to Commonwealth citizens;

Commonwealth citizens who marry belongers;

children born in Hong Kong to BDTCS connected with other Dependent Territories; and

children, wherever born, born to a belonger.

In summary, the main legal and practical effect of not enacting this Bill will be that more persons will acquire belonger status than would otherwise be the case if the Bill were enacted before 1 January 1983.

The main object of this Bill is to amend Hong Kong legislation by substituting, where necessary and from 1 January 1983, the new terminology adopted by the BNA 1981.

These proposals would set out clearly in Hong Kong legislation the changes stemming from the BNA 1981.

However, by reason of the

provisions of section 51 of the BNA 1981 which apply to Hong Kong and irrespective of whether or not this Bill is enacted the necessary amendments will be deemed to have had effect.

This Bill, which has not yet been issued to Members, seeks to amend the British Nationality (Miscellaneous Provisions) Ordinance from 1 January 1983 so that applications made and fees collected for naturalisation or registration are in respect of naturalisation or registration as a BDTC and not as a CUKC. Increases in fees are not proposed.

The effect of the Bill not being enacted will be that no fees can be levied in Hong Kong in respect of naturalisation or registration as a BDTC. Thus people who will be entitled to registration or who apply for naturalisation under the BNA 1981, will have to be registered or naturalised free of charge. The likely annual loss of revenue is $3 million.
