SUBJECT: MR ONSLOW'S VISIT TO THE FALKLAND ISLANDS

BRITISH NATIONALITY ACT 1981

BACKGROUND BRIEF

Enclosures-flag(s)...........

The present position

The basic concept of the new Nationality Act is

that British Citizenship (BC), which carries the right

of abode in the United Kingdom, is confined to persons

with a close UK connection. Similarly British Dependent

Territories Citizenship (BDTC) will be held by those with

similarly close ties with one or more dependencies.

1

f

Consequently from 1 January 1983 some 1400 Falkland Island-

ers will automatically become BCs (as well as in most cases

BDTCS) by virtue of their connections by birth, descent,

naturalisation or registration with the UK. The remaining

400 Falkland Islanders who are subject to immigration

control lack these connections and will become BDTCs only.

However these 400 future BDTCs received a public assurance

from the Home Secretary on 8 April that they would have no

difficulty over admission to the UK whether or not thev

had the right of abode.
