Statutory requirements

Nationality status
(a) British Dependent Territories citizen
This status is or has been acquired under sections 15 - 23 of the 1981 Act by persons connected with the territories
listed in Schedule 6 to the Act.
(b) British Overseas citizen
This status is or has been acquired under sections 26 28
of the 1981 Act.
(c) British subject under the Act
(1) Former British subjects without citizenship
A person who immediately before commencement was a
British subject without citizenship under section 13
or 16 of the British Nationality Act 1948, or who
was a British subject by registration under section 1
of the British Nationality Act 1965, will from
commencement be a British subject by virtue of section
30 of the 1981 Act.
(ii) British subjects connected with the Republic of Ireland
A person who was immediately before 1 January 1949 both
a British subject and a citizen of Eire, and who has
made a clain under section 2 of the 1948 Act, will
at commencement be a British subject by virtue of
section 31(2) of the 1981 Act. Those who have not
made claims under section 2 of the 1948 Act will
continue to be able to make claims to remain British
subjects by virtue of section 31(3) of the 1981 Act.
(iii) Other provisions for acquisition of British subject
status
Section 32 gives the Home Secretary discretion to
register any minor child as a British subject.
(iv) Under section 33, a woman who immediately before
commencement was married to a British subject will
