I confess I think that the European decision is wrongly decided. But be that as it may, it seems to me that the indications are that the United Nations would take the opposite view to the European Court. say this as I have discovered and read since we spoke the Report of a Committee established by the Commission on Human Rights and published by the United Nations in 1964. They specifically considered Article 9(4) which is of course the article in question here, and specifically state at page 141 of their report:

"575. As regards the scope of remedies, the Committee believes that all cases of wrongful deprivation of liberty from the very initial arrest or seizure by the police or private persons to confirmations or extensions of custody by judicial authorities must be reviewable. This result may be achieved in various ways: either by introducing "habeus corpus" or "amparo" in their unrestricted form; or by greatly expanding appeal procedures; or by establishing a proper relationship between regular appeals and special remedies."
