WE WOULD NOT CONSIDER IT APPROPRIATE TO MAKE USE OF THE POWERS IN ARTICLE 80(1)(C) OF THE AIR NAVIGATION (OVERSEAS TERRITORIES)
ORDER BECAUSE OUR CONCERN IS NOT WITH THE FITNESS OF THE AIRGRAFT
SO MUCH AS WITH THE INADEQUATE AND INCORRECT DOCUMENTATION. 2. WE PRESUME THAT THE REFERENCE TO ARTICLE 80(2)(B) OF
THE ORDER IS A TYPING ERROR. WE INTERPRET THE ACCOMPANYING REMARKS TO SUGGEST THAT REFUSAL TO GIVE AIR TRAFFIC CONTROL CLEARANCE MAY BE A POSSIBLE SANCTION. HOWEVER WE COULD NOT CONSIDER THIS OPTION ON AVIATION SAFETY GROUNDS, WE HOPE THAT THE QUESTION OF
IMPOSING SANCTIONS DOES NOT ARISE.
3. MEANWHILE THE NAURU SECRETARY FOR ISLAND DEVELOPEMENT, INDUSTRY
AND CIVIL AVIATION, MR KINZA CLODUMAR, AND THE ACTING CHIEF PILOT OF AIR NAURU, CAPTAIN M J BASTON, HAVE NOW ARRIVED IN HONG
KONG AND A MEETING HAS TAKEN PLACE. WE HAVE POINTED OUT THE DEFICIENCIES IN DOCUMENTATION AND HAVE INDICATED THAT WE WOULD NEED
TO SEE ALL MAJOR ITEMS RECTIFIED BEFORE WE COULD RECOMMEND
RESUMPTION OF PUBLIC TRANSPORT SERVICES OR WITHDRAW OUR OBJECTIONS
TO THE PRIVATE FLIGHTS PROPOSAL.
4. THE NAURU PARTY INTEND TO REMAIN IN HONG KONG TO CONTINUE DISCUSSIONS. WE SHALL REPORT FURTHER.
