4. COMPENSATION FOR DEATH OR INJURY BY ACCIDENT (OR OCCUPATIONAL

DISEASE) ARISING OUT OF AND IN THE COURSE OF EPLOYMENT, INCLUDING WARLIKE OPERATIONS, WHILST SERVICE AS A MEIDER OF THE CREW OF THE SHIF

The company agrees with each of the seaman that, if he suffers personal injury (including death) by accident arising out of and in the course of his employment under this agreement, it will pay such compensation in respect of that injury as it would be liable to pay under Fart II of the Workmen's Compensation Ordinance of Hong Kong if the seaman and the Company were respectively a workman and his employer within the meaning of that Ordinance and that Ordinance applied to that injury.

5. OTHER LIABILITIES OF THE EMPLOYMENT WHEN A SEAMAN SUFFERS INJURY OR SICKNESS ARISING OUT OF OR DURING THE COURS OF HIS EMPLOYMENT ON BOARD OUTSIDE HONG KONG

(i)

The employer shall pay the seaman Article rate of wages during the time he is on board ship.

(ii) The employer shall pay the seaman his article rate of wages for

a period of up to 12 weeks from the time he leaves the vessel for medical treatment or until his arrival in Hong Kong, or he rejoins his ship or another ship of the same Company whichever is the loss. If after expiry of the said period of 12 weeks the seaman is still not fit to be repatriated the seaman shall be entitled to not less than two-thirds wages until he is declared fit to be repatriated or the degree of his permanent disability has been assessed.

(iii) If on repatriation the seaman is still suffering temporary, total

or partial incapacity he shall continue to receive payment of not less than two-thirds earnings until has degree of permanent incapacity has been assessed.

6. LIABILITY OF THE EMPLOYER WHEN SEAMAN DIES ABOARD

(i) The employer shall bear in full the cost of burial or cremation

aboard.

(ii) The employer shall bear in full the cost of transporting the

ashes if cremated and the deceased's personal effects back to Hong Kong or his home port.

7. ALLOTENTS AND REMITTANCES

The seaman shall be entitled to make an allotment at any time and the Master shall provide the seaman with facilities to do so in accordance with the "forchant Shipping (Seamen's allotments) regulations.

8. ADVANCE OF WAGES

The seaman shall be entitled to not more than one month's advance of wages on engagement. Subsequent advance of wages shall be at the Master's discretion, and will be subject to the requirements of the United Kingdom law, to currency control regulations at ports aboard, if applicable, and to the official rate of exchange pertaining at the time of payment of the advance.
