Subject

1. Report of the

Committee of Review, Landlord and Tenant

(Consolidation) Ordinance.

Purpose

Tol consider the recommendations in the Committee's Report and the extent and timing of their adoption.

Progress Made & Present Position

The Landlord & Tenant (Consolidation) (Amendment) (No. 2) Ordinance was enacted in December 1981. Major provisions were -

(a)

extension of rent controls on post war domestic premises until December 1983;

(b) raising the maximum biennial increase in

rent to 30%;

(c) exclusion of premises of a very high

rateable value, and all premises, completed after June 1981 from the Part II rent controls;

(d)

provision by way of a new Part IV for reasonable security of tenure to tenants excluded from the Part I and Part II controls;

transfer of jurisdiction in landlord and tenant matters, otherwise than where criminal sanctions are involved, from the District Court and Tenancy Tribunal to the Lands Tribunal;

extension to sub-tenancies of the same system of rent increase control as applies to principal tenancies;

Next Quarter's Target

(a) To consider the

position of corporate tenancies in regard to controls over rent and security of tenure;

(b) to monitor the

transfer of jurisdiction under the Ordinance from the District Court and Tenancy Tribunal to the Lands Tribunal;

(c) to monitor the

working of the new Part IV provisions;

(a) to keep the

legislation and its effects under review.
