HONG KONG : INTERPRETATION OF CR 58(1)

Please see Hong Kong's letter of 29 October attached. This is a matter on which we shall eventually need to seek Legal Advisers' views. In the meantime I should be grateful for your comments. I do not think that we have details of 'how CR 58(1) is interpreted in other territories. I assume that CR 57(VI) is the CR applicable to other DTs, but I doubt if comparison with present practice will be of use to Hong Kong's special circumstances.
2.
My own feelings are that a more liberal interpretation of CR 58(1)'s 'proceedings' would be adequate. I assume that this can be implemented by administrative change.
