Thank you for your letters of 12-May and 20 May about Crown servants on secondment. I am sorry you have not had an earlier reply. As you surmised, our submission to Ministers had already gone forward by the time we received your first letter.

We agree that this category should be broader than just Crown servants seconded to international organisations, and the definition provided by Bill Lee in paragraph 2(b) of his minute of 26 November 1980 (a copy of which you enclosed with your letter of 23 March) ought to meet the case. But it would be helpful if, before we instruct our Legal Advisers, you could let us know your preferred solution.

We will also need your advice, when we prepare our instructions, on how best to define the other FCO candidates, ie the British Council, HMOCS, HMOJ Governors and NATO (assuming that we clear the recruitment hurdle). To meet our timetable we shall have to put instructions to our Legal Adviser's Branch very soon and I would be most grateful for a reply by the end of next week at the latest.
