"(2) Nothing in subsection (1) shall empower the Governor to

order that the Registrar shall delete from the register

the name of any person who is for the time being a person to whom paragraph (a) or paragraph (b) of section 3 refers."

Explanatory Honorandum

This Bill would amend the Gibraltarian Status Ordinance (Chapter 70)

to provide that any person who is British citizen by virtue of

registration under section 5 of the British Hationality Act 1971 or the

is a British Dependent Territories citizen by virtue of a connection with

Gibraltar, is a Gibraltarian for the purposes of the principal Ordinance and

is entitled to have his name kept on the Register of Gibraltarians.

The expression "British Dependent Territories citizen by virtue of a

connection with Gibraltar" would be defined in the Interpretation and

General Clauses Ordinance. In general terms, it would mean a citizen by virtue of birth, registration or naturalisation in Gibraltar.

The Bill would come into operation

on 1 January 1983.
