DEFINITION OF UK NATIONALS FOR EC PURPOSES

My Danish opposite number, Eva Glistrup, followed up with me the point raised by Denmark in the GAG on identification of passports of entitled nationals, and also raised with me a new point on the right of abode in the UK of those connected with Gibraltar whom we are bringing in under the revised definition. She said that while the passport point could be followed up at leisure, the Presidency would not be willing to let our Declaration through COREPER as an 'A' Point until they were satisfied on the returnability of those connected with Gibraltar in the new category. What essentially concerned them was that they might be obliged, under Community law, to admit certain persons not covered by the old Declaration, but these persons would not be returnable without question to the UK because they might not have the right of abode in the UK.

I spoke to Jeremy Hill on these points and he very kindly sent me comprehensive briefing on them, which with some very slight shortening, I have converted into a reply to the Danes and have today passed to Eva Glistrup. I enclose a copy. She said she would be in touch if they had any further questions. It would still be our hope to clear COREPER next week in time for one of the December Councils. The last possibility appears to be the ECOFIN Council on 17 December. I am copying the enclosure only to Jeremy Hill, and I leave it to you to give any further distribution in London which you think necessary.
