of other damage to less than 5 million SDRs or such higher amount

may be established by the legislation of a contracting party. It will thus bring the Paris Convention into line with the existing

United Kingdom position, except that it will allow a higher

threshold to be set for the amount which must be available for other

damage.

36. It is proposed to take advantage of this provision and to

substitute for the figure of £2,100,000 in section 21 (1) the figure of £6 million_7.

Increases in Limits

37. It is also desired that the Secretary of State should be

empowered, by order made by statutory instrument with the approval

of the Treasury, to increase any of the new figures mentioned

in paragraphs 15, 26 and 36 above. Such orders should be required to be aid in draft before the House of Commons and approved by a

resolution of that House before being made. Subject to the

foregoing, it is not intended that there should be any limit on the

amount by which the Secretary of State may raise any of these figures or on the number of occasions on which the power may be

exercised.

Certificates of Financial Security

38.

Article 4 of the Paris Convention provides that the operator of a nuclear installation shall be liable for nuclear damage caused in certain circumstances during the course of carriage. Article 4(c) provides that the operator shall provide the carrier of nuclear

material with a certificate issued by or on behalf of the insurer or other financial guarantor setting out certain specified information.
