liability is limited in amount; (Article 7 and section 16);

the operator is required to provide financial security for the liability by insurance or otherwise; (Article 10 and section

19 (1) );

time limits are imposed for the bringing of claims (Article 8

and section 15).

5. The Brussels Convention provides for the "topping up" of compensation, if the damage done or injury suffered is greater than the amount for which the operator is liable under the Paris Convention, first by means of funds provided by the operator's state, and then by funds from the other states who have ratified the

Convention.

6. The United Kingdom has ratified the Paris and Brussels Convention but not the Vienna Convention whose provisions are broadly similar, although it is intended that it shall have worldwide

rather than regional application. The Vienna Convention came into

force on 12th November 1977. Although it is unlikely that the United Kingdom will wish to ratify the Vienna Convention in the

forseeable future, the intention behind the 1965 legislation was that it should be in a position to do so should that become possible. So far as possible, the changes to be brought about in pursuance of these instructions should maintain that position.

7. The main purpose of the changes to the Conventions is to raise the overall limits on the contributions made by States under the Brussels Convention, broadly in line with inflation in Convention
