To date, whilst the Commission has from time to time elicited
some startling but nonetheless valuable evidence, scant regard has been paid to the reputations of individuals some of which
have been or may be unjustly but immeasurably damaged by
unsupported conjecture in public. Examples in senior Government
circles include
a)
AG whose personal integrity appears likely to be
critically analysed in great detail in relation
to certain matters such as his press release in
answer to Ms. Elliott's allegations; his alleged impropriety in speaking to Fulton's solicitor to
try to prevent his press release at a time when
Fulton was the main witness in a CAPO investigation
into SIU; the alleged delays in reporting to CAPO
complaints against the SIU; his "charter" letter of 31/8/79 (Appendix 1); his firm stand on prosecution of homosexual offenders where proper evidence existed, and especially his decision to proceed with the prosecution of MacLennan;
b)
CJ and Macdougall J. in relation to wild and
unsupported suggestions of homosexuality and supposed -links with their professional behaviour in some
instances;
c)
Crown Solicitor (as Acting AG) and other members of the Legal Department in relation to the discharge of their professional duties in recommending, or not,
the institution of prosecutions for homosexual offences;
a)
CP in relation to allegations of homosexuality;
e)
DCP Moor in relation to his role in investigating
allegations against CP and as the officer ultimately in command of the SIU.
