anyone nor did he say that he was being got rid of because he knew of matters of a homosexual nature which involved senior Police officers which the deceased had been investigating previously. The decision to terminate the contract of the deceased was made by the Acting Commissioner of Police after careful consideration of all the facts as set out in file YL/XRB 5828/78.

INVESTIGATION BY THE SPECIAL INVESTIGATION UNIT

Mr. R.L.Brooks, Superintendent of Police is the officer in charge of the Special Investigation Unit of CID HQ. He will state that this Unit was set up in August 1978 by the Commissioner of Police and was tasked to investigate the procurement of youths for acts of homosexuality. He has been in charge of the Unit since its formation except for a period from 1.3.79 14.8.79 when he was on vacation leave and the unit was under the command of his 2 i/c Mr. M.F. Quinn, Chief Inspector of Police.

He will state that information was gathered and conclusive evidence was gleaned which indicated that the deceased, over a period, had picked up several male prostitutes and had committed homosexual offences with them. This evidence emanated from the Unit's enquiries into a ring of male prostitutes who worked in the Tsim Sha Tsui area. There were indications that the deceased may have been one of the customers of those prostitutes and as the charter of the SIU included possible security risks it was decided to investigate this possibility. An intelligence file was built up on the deceased and the file was completed on 26.10.79. The matter was reported to Brooks' immediate superior Mr. W.M. Ross, Chief Superintendent of Police.. Both Ross and Brooks then briefed the Director of Criminal Investigation Mr. P.J. Clancy. Mr. Brooks will further state

that the file was discussed by Mr. Clancy and the Deputy Commissioner of Police Operations, Mr. P.T. Moor, and that on the advice of the Attorney General (if the evidence was substantial) the action recommended was that the SIU arrest the deceased and take him before the court. Mr. Quinn prepared a court file and Mr. Brooks took the file to Mr. N. Macdougal, the Crown Prosecutor who, after consulting the Attorney General recommended arrest action.

As two of the potential witnesses against the deceased were involved in a blackmail case against another Government officer, Legal Department advised not to proceed with the charges relating to those two witnesses. Other witnesses against the deceased were available and this was later reviewed by Crown Counsel who on 3.1.80 advised the SIU to proceed on eight charges of Gross Indecency against the deceased. The date for the arrest was set for 15th January 1980, and the plan was to have the
