By Section 8 of the Commissions of Inquiry Ordinance, Chapter 86, Laws of Hong Kong, it is an offence punishable on summary conviction by a fine of $1,000.00 and imprisonment for three months, to fail to answer to a Witness Summons issued by the Commission. In the circumstances, the Commissioner believes that Mr. Duffy is outside the jurisdiction, and considers that he has deliberately failed to respond to the Witness Summons lawfully served. Accordingly, pursuant to Part II of the Magistrates Ordinance, the Commissioner has instructed that an information be laid before a Magistrate to seek a Warrant to be issued for the arrest of Mr. Duffy upon his next return to Hong Kong, so that he may be brought before the Court to answer the said information.
