The proposed amendments to the Immigration Ordinance, the Crimes Ordinance and the Registration of Persons Ordinance contained in the Bills at Annex A to C provide as follows:

The penalty for forgery of identity cards, documents issued under the Registration of Persons Ordinance, travel documents and Vietnamese refugee cards will be increased to a maximum of 14 years imprisonment. These increases will be effected by amendments to section 71(2) of the Crimes Ordinance (Chapter 200) and section 42 of the Immigration Ordinance (Chapter 115).

As a new provision, any person found to be in possession of anything fit and intended for use in forgery will be liable to a maximum penalty of 14 years' imprisonment. It would also place the burden of proof in any proceedings for the offence upon the accused. This will be effected by creating a new section 76A of the Crimes Ordinance (Chapter 200).
