THE IMMIGRATION (AMENDMENT)(NO. 2) ORDINANCE 1981
(No. 64 of 1981)
The sole purpose of this Ordinance is to restore transitional provisions for the avoidance of doubt.
2. In the process of revising the principal Ordinance the transitional provisions originally contained in the Second Schedule to the Immigration Ordinance 1971 (No. 55 of 1971), which were thought to be spent, were omitted from the 1977 edition and subsequent revised editions under powers conferred by the Revised Edition of the Laws Ordinance 1961. Nevertheless it has since proved necessary to rely upon some of those provisions. In a recent judgment of the Court of Appeal, some doubt was expressed as to whether the transitional provisions could have survived their omission from the 1977 and 1979 revised editions.
3. It is accordingly considered desirable for the avoidance of doubt to restore the transitional provisions. Notwithstanding that some of these provisions have quite clearly had their effect, it is considered prudent and appropriate to restore all the provisions contained in the Second Schedule.
4. Before the Acting Governor assented to the Bill in the name and on behalf of Her Majesty, the Attorney General advised that he could properly do so.
