Existing Penalties
Forgery

Penalties for the forgery of these types of documents fall into
the following 3 main categories:
(a)
The Immigration Ordinance (Chapter 115)
Section 42 provides, in relation to forgery of travel documents and Vietnamese refugee cards, a maximum penalty of:
(i)
(ii)

(c)
7 years' imprisonment and a fine of $50,000 on conviction on indictment; or
2 years' imprisonment and a fine of $20,000 on summary conviction.
The Road Traffic Ordinance (Chapter 220)
Section 33 provides a maximum penalty of 6 months' imprisonment and a fine of $1,000 for forgery of driving licences.
The Crimes Ordinance (Chapter 200)
There are no specific statutory provisions relating to forgery of identity cards, acknowledgements of applications for first registration or for new identity cards, or Services' identity cards. Forgery of such documents can however be prosecuted under section 72, and a maximum penalty of 3 years' imprisonment and a fine of an unspecified amount may be imposed.
Possession of Forged Documents

Penalties for the possession of forged documents of identity fall
into the following 3 main categories:
(a)
The Immigration Ordinance (Chapter 115)
Section 42 provides similar penalties for possession of forged travel documents and Vietnamese refugee
cards as for forgery of such. (See paragraph 4(a) above).
