The Director of Immigration has examined the case looking for any grounds which might warrant exceptional approval of Mr Vuong's application, but has found none. Mr Vuong is presently employed as a mechanic. There is no evidence that he and his family are suffering any great hardship in Vietnam. Their applications fall outside the policy approved by the Governor in Council on 14th March 1978, which is summarised at Annex B. The Director of Immigration accordingly recommends that the original decision to refuse visas for Mr Vuong and his wife and two children be confirmed.

Advice sought

Members will be asked to advise, under section 53 of the Immigration Ordinance (Chapter 115), whether the decision of the Director of Immigration not to allow Mr Vuong and his family to enter Hong Kong should be confirmed or reversed.

(The Deputy Director of Immigration (Mr A. J. CARTER) will attend before the Council for the discussion of this item).
