The Secretary for Security reported at the meeting of the GSC on the 6th November that cases were now occurring in which women illegal immigrants were surfacing in the ante- natal and maternity sections of clinics/hospitals prior to giving birth to children. The question arises whether such persons should normally be removed to China.

Where such cases come to notice and so far there have been about a dozen - the Director or Deputy Director almost invariably issue a removal order unless they are satisfied that there are very compelling grounds for not doing so. Following this the appeals procedure comes into force and the Secretary for Security considers appeals on humanitarian grounds. So far all cases have resulted in an appeal.

Previous experience in dealing with appeals has shown very strongly the desirability of not attempting to lay down rigid criteria by which each case is judged. Each case is therefore judged strictly on its merits and requires a highly subjective judgement.

where the woman is certified fit to travel and a decision is taken that in all the circumstances the appeal should be rejected she is repatriated to China prior to the birth of the child;
where the medical advice is that she is not fit to travel and where, having reviewed the caso, it is decided that the petition should be påjected she is permitted to have her child
