I enclose a draft of the new clause asked for in your letter of

18 March.

As agreed subsection (4) is purely discretionary. You told me

that you do not want to provide for particular periods of service.

to which subsection (4) applies to be treated as periods of

presence in the United Kingdom.

In subsection (4), you were inclined to think that the words

"outside the United Kingdom", which I have put in square brackets,

are desirable.

As regards subsection (5)(b), Clift is evidently concerned only to

bring in members of the Executive and Legislative Councils in

Hong Kong, the members of whom are all appointed either by the

Secretary of State or by the Governor on his behalf; and he was

inclined to think that the formula which appears in that paragraph

would suffice for this purpose. In particular, he was not worried

about elected members of similar Councils elsewhere.
